Terms and conditions of sale
These terms govern sales of antiques, works of art and related services supplied by GSLR Antiques. They apply to every order unless specific terms have been agreed in writing.
1. Purpose and scope
These terms and conditions define the respective rights and obligations of GSLR Antiques and its customers in connection with the sale of antiques, period furniture, works of art, collectors’ items and, where applicable, related services.
Placing an order constitutes full acceptance of these terms. Any specific terms agreed in writing with the customer shall prevail where they conflict with these general terms.
2. Description and condition of the items
Most items offered by GSLR Antiques are antique, rare or unique pieces. They are generally available as a single example and cannot always be replaced or exchanged for an identical item.
Each item is presented with a description and photographs intended to be as accurate as reasonably possible. Customers should examine them carefully and request any additional information or photographs they may require before confirming an order.
Due to their age, items may show wear, restoration, irregularities, signs of use or imperfections resulting from the manufacturing techniques of their period. Where visible or disclosed, such characteristics form part of the history and authenticity of the item and do not necessarily constitute a defect.
Measurements, weights, colours and dates are provided with care. Minor variations may nevertheless arise from photography, screen display, measuring methods or the nature of the object.
The purchaser must use, handle and maintain each item with due regard to its nature, age and fragility. GSLR Antiques is not liable for deterioration occurring after delivery as a result of unsuitable use, handling, maintenance or storage conditions.
3. Prices
The applicable price is the price confirmed to the customer when the order is accepted. Prices are stated in euros and include applicable taxes where required.
Unless expressly stated otherwise, the item price does not include delivery, insurance, special packing, customs duties, import charges or taxes payable in the country of destination. Such costs will be stated or estimated before the order is finally confirmed.
Deliveries outside the European Union may be subject to customs duties, import taxes or clearance fees charged by the authorities or carrier. These costs are payable by the customer and are not collected by GSLR Antiques.
4. Orders and availability
An order becomes final only after confirmation by GSLR Antiques and agreement on the item, price, payment arrangements and, where organised by GSLR Antiques, delivery.
Display of an item on the website does not guarantee immediate availability. As pieces are often unique and may be offered simultaneously through several channels, GSLR Antiques may reject or cancel an order if an item has already been sold, reserved or withdrawn. Any amount already paid for a sale that can no longer be completed will be refunded.
A reservation may be conditional upon payment of a deposit. The amount and reservation period will be stated before payment. Unless otherwise agreed or where a statutory withdrawal right applies, a deposit may be retained if the customer cancels. If GSLR Antiques cancels the sale, the deposit will be returned in accordance with applicable law.
5. Payment
Subject to prior agreement, payment may be made:
- by bank transfer;
- by French bank cheque, subject to cleared funds;
- by any other method expressly accepted by GSLR Antiques before the order is placed.
Any lawful charge associated with the chosen payment method will be disclosed before the order is confirmed.
Unless otherwise agreed in writing, cleared payment in full must be received before collection or dispatch. If payment is not received within the agreed period, GSLR Antiques may cancel the reservation and offer the item for sale again after informing the customer.
6. Retention of title
Title to the goods remains with GSLR Antiques until the full purchase price, delivery charges and any other agreed sums have been paid in cleared funds.
7. Delivery and collection
Depending on the item and the agreement with the customer, delivery may take place:
- by collection or hand delivery by appointment;
- by postal or parcel service for suitable smaller items;
- by a specialist carrier for large, fragile or high-value items.
The cost, method and estimated timeframe will be stated before the order is confirmed. Delivery times may vary according to destination, carrier availability, customs formalities and closure periods. Unless an essential fixed date has expressly been agreed, quoted delivery times are estimates.
GSLR Antiques takes great care in packing and preparing each item. Where a carrier is offered or arranged by GSLR Antiques for a consumer, the risk of loss or damage passes when the customer takes physical possession of the goods. Where the customer appoints a carrier not proposed by GSLR Antiques, risk passes in accordance with the applicable mandatory rules.
If the recipient is absent at an agreed delivery appointment, any further delivery, storage or return costs charged by the carrier may be payable by the customer.
Further details are provided on our Delivery information page.
8. Inspection on delivery and transit damage
The customer should inspect the apparent condition of the packaging and the item on delivery. If damage is found, the customer should record precise reservations with the carrier, retain all packaging and immediately photograph both the parcel and the item.
GSLR Antiques should be informed as soon as possible so that a claim may be opened with the carrier or insurer. These practical steps do not deprive consumers of any statutory rights.
9. Withdrawal rights — European consumers
Where a distance contract is concluded with a consumer established in the European Union, or where equivalent mandatory provisions apply, the customer will generally have fourteen days from the day after physical receipt of the goods in which to exercise a statutory right of withdrawal without giving a reason.
To exercise that right, the customer must send a clear statement before the deadline by email, post or by using the model form at the end of this page. Merely refusing delivery or returning the goods without a prior statement is not sufficient.
The goods must then be returned no later than fourteen days after notice of withdrawal is given. Direct return costs are payable by the customer. For goods which cannot normally be returned by post, the cost depends on size, weight, destination and the chosen carrier; an estimate may be supplied before purchase.
Returns must be packed and insured appropriately for the nature and value of the item. The customer may be liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the goods.
Following a valid withdrawal, GSLR Antiques will refund the sums legally due, including the original delivery charge up to the cost of the least expensive standard delivery method offered. Any additional cost arising from the customer’s choice of a more expensive delivery method is not refundable. Refunds are made within the statutory period and may be withheld until the goods have been recovered or evidence of dispatch has been supplied, whichever occurs first.
The right of withdrawal does not apply where excluded by law, including to goods made, altered or clearly personalised to the customer’s specifications.
Purchases concluded in person at GSLR Antiques’ premises after inspection of the item are not covered by the statutory withdrawal right applicable to distance contracts.
To exercise the right of withdrawal, the customer must send a clear statement by post or email before the statutory deadline, quoting the order reference and the item concerned. GSLR Antiques will acknowledge receipt of the request and provide the appropriate return instructions, taking into account the nature, size and fragility of the item. No item may be returned without the prior agreement of GSLR Antiques regarding the return arrangements, carrier and insurance.
10. Customers outside the European Union
The European fourteen-day withdrawal right does not automatically apply to customers outside the European Union. Unless mandatory law applicable to the contract provides otherwise, or GSLR Antiques agrees in writing, sales to non-EU destinations are final.
An exceptional return request may nevertheless be considered on a case-by-case basis. No return may be made without prior written authorisation setting out the return address, carriage, insurance, customs formalities and financial terms.
11. Statutory guarantees and authenticity
Consumers retain all statutory guarantees and remedies applicable to the sale, including the French statutory guarantees of conformity and against hidden defects where those rules apply.
GSLR Antiques selects, researches and describes items with due professional care on the basis of the knowledge and information available at the time of sale. In the field of antiques and works of art, attributions, dates, origins and descriptions may involve an element of professional judgement.
Where a certificate, expert opinion or particular document is included in the sale, this will be expressly stated. Otherwise, the item description, photographs and written exchanges constitute the information supplied before purchase.
12. Force majeure
GSLR Antiques is not liable for delay or failure caused by an event constituting force majeure under French law, without prejudice to any mandatory consumer rights.
13. Personal data
Information collected in connection with an enquiry or order is used to manage the commercial relationship, arrange payment and delivery, comply with accounting and legal duties and respond to the customer. It is not sold to third parties.
Customers may exercise their rights under applicable data-protection law by using our contact form.
14. Complaints, consumer mediation and governing law
Any complaint should first be submitted to GSLR Antiques so that an amicable solution may be sought. Customers may use the contact form or write to the address stated in the legal notice.
Following a prior written complaint that has not produced a satisfactory solution, a consumer may use, free of charge, the consumer mediation scheme applicable to GSLR Antiques. Details of the competent mediator should be consulted in the legal notice or requested from GSLR Antiques.
These terms are governed by French law, without depriving a consumer resident in another country of any mandatory protection granted by the law of their habitual residence. Any dispute that cannot be settled amicably shall be heard by the court having jurisdiction under the applicable legal rules.
